1. Introduction
Welcome to Just Sleep Care. These Terms of Service (“Terms”) outline important information you need to know when accessing the Just Sleep Care Inc. website at www.justsleepcare.com (the “Site”).
In these Terms, “you,” “your,” and “end user” refer to you, the person using the Site. “Just Sleep Care Inc.,” “ourselves,” “we,” “our,” and “us” refer to Just Sleep Care Inc. “Party” and “parties” refer to you and us together.
By accessing this Site, you represent that you have reached the age of majority in your province or territory of residence, and that you accept these Terms for the entirety of your use of www.justsleepcare.com. You agree that these Terms, and any dispute arising from your use of this website, will be governed by the laws of Alberta and the federal laws of Canada applicable therein, and you submit to the exclusive jurisdiction of the courts located in Alberta.
We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the most recent revision, and your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If you do not agree with any part of these Terms, please discontinue your use of this website. If you wish to use this website and our referral services, please carefully read the following information.
2. Definitions
• “Content” means all text, graphics, images, software, and other materials made available on the Site.
• “Services” means the referral, information, and coordination services offered by Just Sleep Care Inc. through the Site, including connecting end users with licensed sleep physicians, members of the medical team, and home sleep testing.
• “Site” means the website located at www.justsleepcare.com and any related subdomains or applications operated by Just Sleep Care Inc.
3. Our Services
Just Sleep Care Inc. is an online virtual sleep care platform that coordinates access to the treatment of sleep disorders and the improvement of general sleep quality, through the recommendations of licensed sleep physicians.
To simplify your journey to better sleep, we facilitate home sleep testing, with results interpreted by our licensed sleep physicians and Medical Team, who advise you on the type of medical equipment and support you may require. The home sleep apnea test we use, WatchPAT, is a level 3 sleep study (a home-based test, as opposed to an in-lab overnight study) and is not currently eligible for provincial health plan subsidies.
Clinical consultation services provided by our licensed physicians are billed through Alberta Health. Coverage for home sleep studies or sleep-related equipment, if any, depends entirely on your individual third-party or private insurance policy. Just Sleep Care Inc. does not guarantee reimbursement and recommends confirming your coverage with your insurer before purchasing any equipment.
Just Sleep Care Inc. does not sell sleep studies or sleep equipment directly. Equipment is obtained through a company of your choice either through our network of partnered suppliers or an independent company you select on your own. Just Sleep Care Inc. is not responsible for the pricing, quality, or service provided by any third-party supplier.
4. Intellectual Property Rights
Just Sleep Care Inc. and/or its licensors own the intellectual property rights for all Content made available on www.justsleepcare.com. This information is accessible by you at your own risk and is intended for your personal use only, subject to the restrictions below. During your use of www.justsleepcare.com, you acknowledge that you do not gain any rights to republish, redistribute, reproduce, or sell any Content available on the Site.
By submitting comments or reviews, you grant Just Sleep Care Inc. a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for the purposes of operating and promoting our Services.
Just Sleep Care Inc. reserves the right to remove any offensive or inappropriate feedback or reviews made on www.justsleepcare.com. Please contact us at support@justsleepcare.com to report any offensive content or links found on our website. All reports will be reviewed and seriously considered; however, Just Sleep Care Inc. is not obligated to remove or modify this content.
5. Your Privacy and Registration
Please read our Privacy Policy, available at https://justsleepcar2914.janewebsites.com/privacy-policy which explains how we collect, use, and protect your personal information, including information collected in connection with home sleep testing.
We use JaneApp to manage appointment booking and account access. You are responsible for safeguarding your login credentials and for notifying us immediately at support@justsleepcare.com if you suspect your account has been compromised. You are responsible for account activity resulting from your failure to keep your credentials confidential. This does not apply to unauthorized access resulting from a security failure on our part.
Just Sleep Care Inc. reserves the right to suspend or remove any account being used improperly or in violation of these Terms. Suspension or removal of an account does not affect our obligations to retain your health information as required by applicable law.
6. Warranty Disclaimer
This website and its Services and Content are provided on an "as is" basis, and your use of them is at your own risk. To the maximum extent permitted by applicable law, we disclaim all implied warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement. This disclaimer applies to the website, platform, and related technology, and does not limit or exclude the professional standard of care owed to you by licensed physicians providing clinical services through Just Sleep Care Inc. Nothing in this section limits any warranty, condition, or right that cannot be excluded or limited under applicable consumer protection legislation.
Just Sleep Care Inc. is not liable for planned or unplanned service downtime, or for the consequences or inconveniences caused by such disruptions, except to the extent such liability cannot be excluded by law. If the platform is unavailable and you require urgent medical attention, please contact [emergency services / your local emergency line] directly rather than waiting for the platform to resume.
7. Limitation of Liability
To the extent permitted by law, Just Sleep Care Inc.'s total liability arising from your use of this website or the Services will not exceed the amount you paid to us, if any, in the twelve (12) months preceding the event giving rise to the claim. Just Sleep Care Inc. is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or Services.
Nothing in this section limits liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded or limited under applicable law.
8. Indemnification
You agree to indemnify and hold Just Sleep Care Inc., its officers, directors, employees, and agents harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.
9. Termination
We may suspend or terminate your access to the Site or Services, in whole or in part, at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Site or Services generally. You may stop using the Site at any time. Sections of these Terms that by their nature should survive termination (including Intellectual Property Rights, Warranty Disclaimer, Limitation of Liability, and Indemnification) will continue to apply after termination.
10. Force Majeure
Just Sleep Care Inc. is not responsible for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, labour disputes, internet or telecommunications failures, or acts of government.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the courts located in Alberta.
12. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Just Sleep Care Inc. regarding your use of the Site and Services, and supersede any prior agreements between the parties relating to their subject matter.
